Trusts Law in the Asia-Pacific Region: Reflections and Lessons

ABOUT THE WEBINAR
Trusts law is thriving in the Asia-Pacific region. This comes as no surprise: Asia-Pacific is the world’s most populous region with the fastest economic growth rate; and the trust is well-known for its significant contribution to societal stability and economic prosperity. However, little is known about the use and development of trusts law in the region: Asia-Pacific’s rich cultural, linguistic, and ideological diversity, not to mention its multiplicity of legal traditions, poses analytical and practical challenges for an inclusive and systematic region-wide analysis of trusts law.
Drawing on the pioneering project and book series “Asia-Pacific Trusts Law”, this seminar will reflect on five unique lessons that the region can offer to trusts law scholarship and practice. It will discuss: the status of trusts law in the region; the nature of the trust and how it affects the transplantation of trusts; the dimensions of the trust and how jurisdictions utilise them; constructive and resulting trusts; and choice of law rules for trusts.
ABOUT THE SPEAKER
Dr Liew Ying Khai is a Professor at the Melbourne Law School, University of Melbourne. He teaches and researches in private law, specialising in the law of equity and trusts, the law of assignment, contracts, and remedies. His research has been published in leading peer-reviewed international journals, including the Cambridge Law Journal, Law Quarterly Review, Modern Law Review, Oxford Journal of Legal Studies, Sydney Law Review, UNSW Law Journal, and Melbourne University Law Review. His work has been cited by courts around the world, including the UK Supreme Court, the Supreme Court of India, the Federal Court of Australia, and courts in New Zealand, Hong Kong, Singapore, Ireland, and the Cayman Islands.
Dr Liew is the author of the monograph Rationalising Constructive Trusts (Hart Publishing 2017), and of the practitioners’ text Gueston the Law of Assignment which is currently in its fourth edition (Sweet & Maxwell 2021). He is also the founder of the Asia-Pacific Trusts Law project, and the General Editor of the Asia-Pacific Trusts Law book series (Hart Publishing) which publishes papers presented at a biannual symposium. Two volumes have been published to date: Theory and Practice in Context (2021, with Matthew Harding) and Adaptation in Context (2022, with Ying-Chieh Wu).
Dr Liew is Associate Director (Private Law) of the Asian Law Centre at the Melbourne Law School and is a General Editor of the Journal of Equity.
